Fitness Champs Excellence Sports Academy

1. Definitions

Term / Cycle: a block of ten weeks (or as published), comprising scheduled weekly sessions.
Session / Class: one scheduled lesson of the enrolled programme.
Programme Duration: the published duration for the enrolled programme, as described in Section 4.
Make-up / Replacement Class: a replacement session approved under Section 6.
Start Date: the first scheduled session date for the student in the enrolled term.

2. Enrolment & Slot Confirmation

A student is enrolled and a slot is confirmed only when full payment has been successfully received and reflected in FCESA’s system.
Failed payments do not reserve slots. FCESA may release the slot without further notice.
You must check the selected programme duration and start date before payment. Successful payment confirms the slot subject to facility and safety requirements.
FCESA may refuse, pause, or cancel enrolment when information is incomplete, eligibility criteria are not met, or safety or behaviour concerns present a risk to the student, other participants, staff, or facility.

3. Fees, Term Payment & Proration

3.1 Ten-week upfront payment

All standard swim programmes are billed ten weeks upfront for one term or cycle, unless otherwise stated in writing.

3.2 Prorated fees

When a student starts after the published term begins, or fewer than ten sessions remain, fees are prorated from the Start Date to the end of the term or cycle.

Prorated Fee = (Full 10-week Term Fee ÷ 10) × Number of Remaining Sessions.

Bank or payment-processor charges may still apply and may be non-refundable when a refund is approved.

3.3 Price changes

Fees may be revised with prior notice. New fees apply at the next renewal or term unless otherwise stated.

3.4 Payment methods

Payment may be made only by credit card in the portal. You are responsible for completing payment correctly.

4. Programme Durations, Term Dates, Holidays & Attendance

4.1 Programme durations

Toddlers Programme: 30 minutes per session.
Ladies Swimming Programme: 45 minutes per session.
Termly Children Programme: 45 minutes per session.
Mixed Adult Swimming Programme: 45 minutes per session.
Private / Individual Classes: duration follows the selected category or package and is stated on the programme page, invoice, or confirmation.

4.2 Holidays & scheduling

Unless FCESA states otherwise, lessons may run through public and school holidays within the published term dates.

4.3 Punctuality

Late arrival may reduce in-water time. Coaches cannot extend a session because of safety requirements and class flow.

5. Missed Classes & No-Show

Missed classes without an approved make-up reason under Section 6 are forfeited and non-refundable.
If a student is asked to sit out because of visible illness or a safety concern, the session is generally treated as used unless a make-up is approved under Section 6.

6. Make-Up Classes (Medical, Travel & Approved Reasons)

6.1 Eligible reasons

Medical / Injury: an official medical certificate from a licensed clinic or hospital covering the class date.
Travel: verifiable travel documentation showing that the student is away on the relevant date, such as a flight itinerary, visa or entry record, employer letter, or school letter.
Exceptional circumstances: at FCESA’s discretion and with supporting evidence.

6.2 Non-eligible reasons

Make-ups are not available for personal events, parties, playdates, scheduling conflicts, forgetting, minor ailments without a medical certificate, or choosing not to attend.

6.3 Notice & submission timeline

Notify FCESA before the class starts, or within 24 hours afterward in a genuine emergency.
Supporting documents must be submitted within seven calendar days of the missed class. Late submissions may be rejected.

6.4 Limits, booking & conditions

Make-ups are subject to availability, safety ratios, and class suitability.
Make-ups must be pre-booked and confirmed by FCESA. Walk-ins are not accepted.
A different day, time, venue, or instructor may be offered.
Make-ups must be used within the same term or cycle unless FCESA specifies another expiry date.
Make-ups will not be processed while an outstanding balance remains.

6.5 No-show for a confirmed make-up

A no-show for a confirmed make-up is forfeited and treated as used.

7. Cancellations, Refunds & Credits

7.1 Cancellation by FCESA

If FCESA cancels a class because of coach illness, pool closure, facility repair, water quality, safety restrictions, or a similar reason, FCESA will provide a make-up or another reasonable alternative.

7.2 Cancellation or withdrawal by you

No refund is available for a withdrawal or cancellation initiated by you after the term begins, except where required by law or explicitly approved under Section 7.3.

7.3 Exceptional cases

For an exceptional case such as a long-term medical condition supported by a medical certificate or relocation out of the country, FCESA may issue a credit note or approve a partial prorated refund at its discretion. Approved refunds may exclude administration and payment-processing costs.

8. Coach Changes, Class Format & Progression

Coaches may change for operational reasons.
Student progression and level are determined by termly assessment.
When a level change results in a different fee band, FCESA may apply a fair pro-rata calculation to the remaining sessions.

9. Health, Medical Fitness & Duty of Disclosure

You must disclose medical conditions that may affect safe participation, including asthma, epilepsy, heart conditions, allergies, behavioural concerns, and learning needs.
Do not attend when the student is unwell, including fever, contagious illness, vomiting or diarrhoea, or open wounds.
You confirm that the student is medically fit for aquatic activities and accept that swimming carries inherent risks.

10. Safety Rules, Facility Rules & Behaviour

10.1 FCESA and facility rules

You and the student must follow all FCESA safety rules, coaching instructions, and the rules and directions of facility management, owners, lifeguards, and venue staff.

This includes admission controls, capacity limits, attire, shower and hygiene requirements, lane allocation, pool movement, spectator and waiting-area restrictions, photography restrictions, emergency procedures, and safety directions.
FCESA will immediately implement a facility rule changed at short notice when required for safety or compliance.

10.2 Removal for safety or non-compliance

FCESA may refuse participation, remove a student from the pool, or suspend services when behaviour is unsafe or non-compliant. No refund is payable for removal due to non-compliance, misconduct, or safety risk.

10.3 Parent or guardian supervision

Parents and guardians are responsible for minors outside lesson time and in non-coaching areas such as changing rooms, showers, and waiting areas, subject to venue rules.

10.4 Attending and leaving the facility

Children aged ten and over may attend or leave alone with parent or guardian consent.
Children aged eight or nine must arrive and leave with a parent or guardian. The adult may leave during the session after informing the coach where they can be reached.
Children aged seven and under must always have a parent or guardian within the facility.
Ensure an FCESA coach is present before leaving a child at the venue.

10.5 Collection

All participants should be collected from the pool area.

10.6 Child safeguarding

All staff must follow the UAE Child Protection guidelines.

10.7 Dress code

Children must attend in appropriate clothing: a swimming costume, FCESA swim cap, and goggles.

11. Photography, Video & Use of Images

Photography and video recording during lessons are not allowed without written permission from FCESA.
FCESA may take photos or videos for coaching feedback and marketing. You consent unless you opt out in writing.
FCESA does not sell images to third parties and handles them under applicable privacy requirements.

12. Liability, Exclusion & Indemnity

Swimming and aquatic activities carry inherent risks.
To the maximum extent permitted by law, FCESA is not responsible for injury, loss, damage, illness, or death arising from participation, except to the extent caused by FCESA’s proven negligence where liability cannot legally be excluded.
Annex A, the Indemnity / Release & Waiver Form, forms part of these terms and must be accepted.

13. Personal Data & Communications

FCESA collects and uses personal data for enrolment, safeguarding, payments, scheduling, communications, and programme delivery in accordance with its Privacy Notice.

14. Governing Law & Jurisdiction

These terms are governed by the laws of Dubai and the UAE. Disputes are subject to the courts of Dubai and the UAE unless mandatory law provides otherwise.

15. Acceptance

By completing payment or attending sessions, you confirm acceptance of these terms and Annex A.
